You should apply before your current visa expires — ideally 8–12 weeks before. Once submitted, you can legally remain in the UK while the Home Office processes your application (known as 'Section 3C leave').
Applicants must be in a genuine and subsisting relationship with a British citizen, someone with settled status or pre-settled status in the UK, or a person with refugee or protected status. Both partners must usually be aged 18 or over and intend to live together permanently in the UK. Applicants must usually show that they meet the minimum income requirement set by the Home Office or have sufficient savings to support themselves without relying on public funds. Income can come from employment, self-employment, pensions, or other permitted sources. The exact financial threshold and evidential requirements can vary depending on individual circumstances and any dependent children involved.
Some applicants can switch to an Unmarried Partner Visa from within the UK if they already hold a valid visa that permits switching. An initial Unmarried Partner Visa is usually granted for 2 years and 9 months if applying from outside the UK, or 2 years and 6 months if applying from within the UK.
